TERMS & CONDITIONS

Clear terms for your business.

Read these business subscription terms with the privacy notice and acceptable use policy.

Version 2026-10-17 · For Irish business customers

Draft for review

The operator’s legal details and final approval are still required. Live payment checkout is blocked until this setup is complete.

1. Your agreement

The supplier is the operator identified below. You must be an authorised business representative aged 18 or over. The order summary, these terms, acceptable use policy and agreed data processing agreement form the agreement. Creating an account does not activate answering. A subscription starts after approved checkout; phone activation also requires successful setup.

A checkout return page is not proof of payment: Stripe’s server-confirmed subscription status controls access. The review build blocks live payment until required operator details and final approval are configured.

2. Your receptionist

NeverMiss answers eligible forwarded calls using AI and captures enquiries for your team. Keep your existing number, approve the business knowledge and greeting, verify ownership, and enable carrier-approved forwarding to your allocated AI number. Inventory, regulatory eligibility, your carrier and provider availability affect setup.

A genuine forwarded test, captured enquiry and delivered notification are required before answering activation. Optional Google Calendar or Microsoft Outlook integration is included in Business after the owner authorises a supported account, reviews booking rules and explicitly enables automatic bookings. It supports one person, one primary calendar and one appointment length. Otherwise, appointment requests need your team’s approval. SMS, Calendly integration and team scheduling are not included.

The receptionist checks availability and only confirms an automatic booking after the customer agrees and the provider event is verified. A failed or uncertain result is not a confirmed appointment. Changes made later in the provider calendar are not automatically synchronised to NeverMiss. Manage cancellations and rescheduling directly in that calendar and communicate with your customer. Disconnecting preserves existing events while stopping new NeverMiss bookings.

3. Pricing, allowances and payment

New Business subscriptions are €150/month with 500 AI minutes. Larger volumes require a separate quote. Existing subscriptions retain their agreed price and allowance unless a separate change is accepted. Prices are EUR excluding VAT where applicable. Applicable tax and total payable must be shown before payment. No setup fee or free trial is promised.

Subscriptions renew monthly and are billed in advance through Stripe. Included minutes reset with the billing period and do not roll over. Duration is measured in seconds; displays may round minutes. Allowance is reserved when admitting a call, so answering can stop when the remainder is insufficient for another call.

Paid overages are disabled. Answering stops at the included allowance; no paid continuation is enabled. The supported Google or Microsoft calendar integration has no separate NeverMiss fee. Carrier forwarding and your calendar provider’s own subscription charges may apply. Usage email alerts are not enabled; check your dashboard.

4. Renewal, cancellation and refunds

Cancel renewal in the connected dashboard’s Stripe customer portal or contact support before the next renewal. Cancellation takes effect at the end of the paid period unless an earlier date is agreed or legally required. The portal confirmation shows the effective date. Unused minutes expire when service ends.

Pausing answering or removing forwarding does not cancel billing. A plan change requires confirmed pricing, any proration and an effective date before you agree. Material price changes will be notified before a future renewal so you can cancel.

Partially used periods are not automatically refunded, except where required by law or agreed to resolve an issue. Contact support about duplicate charges, provisioning failures or prolonged unavailability. The operator reviews refunds and disputes; statutory rights remain unaffected. Restore carrier voicemail or other routing before service ends.

5. Your responsibilities

Keep approved business information accurate, protect account access, check enquiries and respond appropriately. Document your caller privacy basis and notices, verify carrier charges and follow the approved forwarding and restoration procedures. Use the service in line with the acceptable use policy. Calculators and sample conversations are illustrative and do not guarantee sales or profit.

6. Availability and safety

AI may misunderstand callers or create inaccurate summaries. Networks and providers can fail. No uninterrupted service or service level is promised unless separately contracted. Answering may be suspended for exhausted allowance, overdue payment, misuse, legal requirements or a security incident, with notice where reasonably possible.

NeverMiss is not an emergency service. Do not use it as a replacement for emergency calling, professional advice, safeguarding or a safety-critical human response. It cannot guarantee delivery or action on urgent messages. Your business is responsible for reviewing notifications and responding.

7. Data and intellectual property

You retain rights in your business information and authorise processing needed to provide the service. Caller data follows your agreed instructions and processing agreement. Export and deletion review are available; legal retention and provider handling may prevent immediate deletion of every record.

Software and assets belong to their rights holders. Three and its logo are trademarks of their respective owners. This independently prepared website does not assert affiliation, approval or an agreement with Three Ireland.

8. Liability and disputes

Each party remains responsible for its legal obligations. To the extent legally permitted for a business contract, neither party is liable for indirect or consequential losses, and the supplier’s aggregate liability is limited to subscription fees paid in the preceding 12 months. This does not exclude fraud, wilful misconduct, liability that cannot lawfully be limited, or mandatory data protection rights.

Contact support first to investigate and resolve concerns. Irish law and courts apply, subject to mandatory rights and jurisdiction rules. Material changes will be notified and any required consent obtained. These draft commercial terms require operator legal review before launch.
